Swiftalent is a SaaS solution focused on revolutionizing the recruitment process through advanced AI-powered tools. We strive to enhance the job matching experience by implementing intelligent screening for candidates and job offers. The matching is powered by both traditional machine learning algorithms as well as modern large-language and deep-learning models.
The Services are developed, maintained, and operated by Code Bakery ("Developer"). All aspects concerning billing, subscriptions, and customer services are managed by the Developer. At Code Bakery, we are committed to ensuring the security and protection of the personal information that is processed and to providing a compliant and consistent approach to data protection. You retain all ownership rights in the content you submit, post, or display on or through our Services ("User Content"). By providing User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, host, store, reproduce, and display such content solely for the purpose of operating, promoting, and improving the Services. The license lasts only as long as your User Content remains on our platform.
We will handle your User Content confidentially and will not disclose it to third parties except as required to provide the Services to you or as required by law.
Third-Party Processing of User Content:
We use third-party processors such as Google's Gemini API and the Azure OpenAI API to process your User Content in order to provide advanced features and functionalities of the Services, including AI-powered document analysis and matching. By using our Services, you consent to the processing of your User Content by these third parties solely for the purpose of providing the Services to you. We ensure that all third-party processors comply with applicable data protection laws and have appropriate safeguards in place to protect your personal data.
You are solely responsible for the User Content you provide and the consequences of posting or publishing it. All User Content must comply with applicable laws and regulations, including but not limited to privacy laws, intellectual property laws, and regulatory requirements. You must not upload or publish false, defamatory, harassing, or obscene material to the Service systems.
You agree to indemnify and hold Code Bakery harmless from any claims, losses, liabilities, damages, expenses, and costs (including, without limitation, attorneys' fees) arising out of or in any way connected with your User Content or your use of the Services.
We may terminate or suspend your account and bar access to the Services immediately, without prior notice or liability, if you breach these Terms or engage in prohibited activities as outlined in the "Permissible Use" section.
Upon termination, your right to use the Services will cease immediately. If your account is terminated due to a breach of these Terms, a prorated refund of any prepaid fees will be issued.
Upon termination, we will delete your User Content and personal data in accordance with our data retention policies, unless we are required to retain it by law.
The Services are provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind, either express or implied. To the maximum extent permitted by applicable law, Code Bakery disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Services will meet your requirements, be uninterrupted, secure, or error-free, or that any defects will be corrected.
To the maximum extent permitted by applicable law, in no event shall Code Bakery be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses arising out of or relating to your use of or inability to use the Services, even if Code Bakery has been advised of the possibility of such damages.
Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability for incidental or consequential damages, so the above limitations may not apply to you.
These Terms shall be governed by and construed in accordance with the laws of Belgium, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located within Belgium to resolve any legal matter arising from these Terms or your use of the Services.
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions of these Terms shall remain in full force and effect.
These Terms constitute the entire agreement between you and Code Bakery regarding the use of the Services and supersede any prior agreements between you and Code Bakery relating to the Services.
